Katya Asher discusses some important changes to US Patent law in the USA in the area of patent validity for Natural Products which are often used in diagnostics. She discusses with Adrian Dawkes the knock on effect in the EU and RoW where these products are still patentable. They also discuss legalities around "Skinny Label" and "Off Label" products.
Katya is a lawyer in the Intellectual Property Group. She specialises in patent litigation and life sciences transactional work. Prior to joining Mishcon, Katya spent five years in one of the premier intellectual property boutiques in the US, where she litigated patent cases in diverse technical areas and prepared patent noninfringement and invalidity opinions in the pharmaceutical field. She then spent two years as the intellectual property counsel at the Pasteur Institute, a French non-profit research organisation. Her transactional work covers patent and know-how licensing and assignments, data purchase, research consortium, funding, research and development, service and material transfer agreements. Katya holds a J.D. and a Bachelor's degree in Biology from University of North Carolina from which she graduated with honours. She also holds a Master 2 degree in Industrial Property from the Pantheon Assas University in Paris, France. Katya is fluent in French and Russian. She is a member of the New York Bar.
